Returns Policy

1. Scope

This Returns Policy (right of withdrawal/returns) applies to all orders placed on the aresshield.ro website, operated by ARESSHIELD S.R.L..

For consumers (natural persons), the right of withdrawal is regulated by Government Emergency Ordinance no. 34/2014 on consumer rights in contracts concluded with professionals.

For legal entities (business customers), ARESSHIELD S.R.L. voluntarily grants a right of return under the conditions set out in the section "Returns for legal entities (business customers)", as a commercial facility, distinct from the legal right of withdrawal applicable to consumers.

This policy complements the Terms and Conditions of the site and must be interpreted together with the Privacy Policy, the Delivery Policy and the Product Warranty.

2. Legal right of withdrawal for consumers (14-day return)

Under GEO 34/2014, the consumer has the right to withdraw from a distance contract (including online orders) within 14 calendar days, without having to justify the decision and without bearing any costs other than those provided by law (mainly the direct cost of returning the products).

2.1. When does the 14-day period start?

The 14-day period is calculated as follows:

• for sales contracts for products – from the date on which the consumer or a third party indicated by them (other than the courier) takes physical possession of the product;
• if an order includes several products delivered separately – from the date of taking physical possession of the last product in the order.

2.2. Who is a "consumer"?

The right of withdrawal regulated by GEO 34/2014 applies exclusively to consumers (natural persons acting outside their commercial, industrial, production, craft or professional activity). For legal entities, this right is not mandatory by law, but ARESSHIELD S.R.L. grants a contractual right of return, as set out in section 9 below.

3. Return conditions (consumers and legal entities)

To benefit from a return (both under the legal right of withdrawal and under the commercial facility for legal entities), you must:

• notify ARESSHIELD S.R.L. of your decision to return within 14 calendar days of delivery (the date of taking physical possession of the product);
• return the products to ARESSHIELD S.R.L. without undue delay and no later than 14 calendar days from the date you communicated your decision to return.

3.1. Condition of the products on return

• The products must be returned, as far as possible, in the same condition in which they were delivered, with all accessories and labels present at the time of delivery.
• It is not mandatory for products to be returned in their original packaging/box, but we would appreciate it if this is possible, to make handling, checking and, where applicable, putting them back on sale easier.
• The customer (consumer or legal entity) is liable only for any diminished value of the products resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the products (e.g. reasonable testing, similar to what is allowed in a physical store).
• In case of obvious damage, signs of excessive use or unauthorized interventions that go beyond this reasonable use, ARESSHIELD S.R.L. reserves the right to withhold an amount corresponding to the diminished value of the product, an amount that will be communicated to the customer, with the appropriate justification.

4. Return procedure (how to exercise the right of withdrawal/return)

4.1. Notification of the intention to return

Before the 14-day period expires, the customer (consumer or legal entity) must inform ARESSHIELD S.R.L. of their decision to withdraw from the contract / return the products. For this, any of the following methods may be used:

• sending an email to aresshield@yahoo.com, clearly stating the intention to return, the order number, the full name / company name and the products to be returned;
• sending a written notification by post/courier to the address: ARESSHIELD S.R.L., Hunedoara County, Petroşani, Str. Avram Iancu, Bl. 9, Et. 8, Ap. 50.

Consumers may also use the model withdrawal form.

4.2. Shipping the returned products

After notification, the products must be sent, without cash on delivery, by courier, to the address:

• The parcel must be packed appropriately so that the products are protected during transport;
• Parcels sent with cash on delivery for the value of the products are not accepted;
• We recommend keeping proof of shipment (AWB, courier receipt), so that you can demonstrate shipment within the legal/commercial 14-day period.

4.3. Return costs

Under GEO 34/2014, the direct costs of returning the products (e.g. the courier fee for the return) are, in principle, borne by the consumer, unless ARESSHIELD S.R.L. has expressly agreed to bear them or has not informed the consumer of these costs.

Similarly, for legal entities, return costs will usually be borne by the customer, except where the return is due to a non-conformity attributable to ARESSHIELD S.R.L. (e.g. wrong product delivered, defect visible on receipt), in which case we will bear the return costs, under the conditions communicated by us to the customer for that case.

5. Refund of amounts

Upon valid exercise of the right of withdrawal (for consumers) or the contractual right of return (for legal entities), ARESSHIELD S.R.L. will refund:

• the value of the returned products;
• for consumers, the cost of the initial standard delivery (if charged), to the extent that the entire order is returned, in accordance with legal provisions (if you opted for a more expensive delivery type than the standard delivery offered, we may refund only the cost of standard delivery).

The refund will be made:

• within 14 calendar days at most of the date on which we were informed of your decision to return;
• using the same payment method you used for the initial transaction, unless we expressly agree on a different refund method (e.g. bank transfer to an IBAN account indicated by you).

We reserve the right to defer the refund until we have received the products back or until we receive proof that the products have been shipped (whichever occurs first), in accordance with Art. 13 of GEO 34/2014 (applicable to consumers) and similar principles applied to returns for legal entities.

6. Exceptions to the right of withdrawal

In certain situations, expressly provided for in Art. 16 of GEO 34/2014, the consumer does not benefit from the right of withdrawal. Common examples:

• clearly personalized products or products made to the consumer's specifications;
• sealed products that cannot be returned for health protection or hygiene reasons and that have been unsealed by the consumer;
• sealed audio or video recordings or sealed computer software that have been unsealed after delivery;
• digital content that is not delivered on a tangible medium, if performance has begun with the consumer's express consent and with confirmation that they are aware they lose their right of withdrawal.

To the extent that ARESSHIELD S.R.L. sells such products, the relevant exceptions will be clearly indicated on the product page and/or when the order is placed. For legal entities, ARESSHIELD S.R.L. may limit or exclude returns for these product categories, with prior notice to the customer.

7. Relationship with the legal guarantee of conformity

The 14-day right of withdrawal/return (legal for consumers and contractual for legal entities) is separate from the rights relating to the legal guarantee of conformity (usually 2 years for new products), regulated by the legislation in force.

Exercising or not exercising the right of return does not affect your rights in case of non-conformity of the product. For details on the legal guarantee and the conditions for granting it, please see Product Warranty.

8. Returns for legal entities (business customers)

Although GEO 34/2014 does not impose a right of withdrawal for legal entities, ARESSHIELD S.R.L. grants business customers (legal entities) a 14-day right of return from the delivery date, under conditions similar to those applicable to consumers, as described in this policy (product condition requirements, procedure, return costs, refund, etc.).

ARESSHIELD S.R.L. nevertheless reserves the right to review return cases for legal entities individually, especially in situations of excessive wear, significant damage or products used for intensive professional purposes, and to determine, where applicable, a reduction of the refunded amount proportional to the diminished value of the products.
